Terms of service

The terms a Zoning-Info engagement runs under: what we deliver, what it costs, what reliance covers, and where the limits sit.

Engagement

An engagement begins when we accept your order against a quoted scope. The quote states the report ordered, the property or jurisdiction, the price, and the target turnaround. Work outside that scope is quoted separately and before it is performed — we do not invoice scope changes after delivery.

Price and document costs

Report prices are fixed as published or as quoted. The first $200 of records-office document cost per report is included. Where document cost will exceed that cap we tell you before we spend it; anything above the cap is itemized at cost without markup.

Invoices are due on the terms stated on the invoice. Reports are delivered on payment or on account, as arranged.

Turnaround

Stated turnarounds run from documents in hand — the point at which the records office has returned what we requested. Retrieval time is set by the jurisdiction and is outside our control. We give you a target date when the file opens and tell you promptly when a jurisdiction is running behind it.

What the report is

A Zoning-Info report is a professional determination made from the ordinance in effect on the date stated in the report and from the documents of record retrieved for the property. It is not a legal opinion, a title opinion, a survey, an appraisal, or a permit.

Where an ordinance is ambiguous we report the ambiguity rather than resolve it in your favour. Where a determination depends on a discretionary approval, we report the standard and the approval body; we do not predict the outcome.

Reliance

Underwritten reliance is included on every report and extends to the relying parties named in the report. Adding a relying party after delivery is available on request. If your lender requires specific reliance language, send it before the file opens so we can tell you whether we can sign it.

Reliance runs to the report as delivered. It does not extend to excerpts, summaries, or restatements of the report prepared by others.

Accuracy and correction

If you believe a finding is wrong, tell us and we will re-examine the file. Where we made an error we correct and reissue the report at no charge. Where a jurisdiction changed its ordinance after the date stated in the report, that is an update rather than a correction, and we will quote it as one.

Your use of the report

The report is prepared for you and the relying parties named in it, for the transaction it was ordered for. You may reproduce it in full within that transaction. Publishing it, reselling it, or presenting it as the basis for a different property or transaction is outside its scope.

Confidentiality

We treat your identity, your transaction, and the contents of your file as confidential. We do not disclose who ordered a report on a property, and we do not use one customer's order to solicit another.

Governing law

These terms are governed by the laws of the State of Oklahoma.
